Helping You With SSDI Appeals
If a SSD claim has been initially denied, the first step in the appeals process is to make a written request within 60 days to make an appeal. There are four levels in the SSDI/SSI appeals process:
- Level One: This is the "reconsideration" level. Through a written request, your case is reviewed by the Disability Determination Service. Your application will be looked at again along with any additional information you send in.
- Level Two: The second level is a hearing before an administrative judge from the Social Security Office of Hearings and Appeals. The judge will review your case and listen to any witnesses or experts that you present.
- Level Three: At the third level, the appeal is before the Appeals Council. You must again request a review before the Appeals Council. The council will either reject your request or send your case back to the administrative law judge.
- Level Four: This is the final level of appeal and can happen if 1), the Appeals Council rejected your request for review or 2), you are appealing their decision. The final appeal is filed in federal court against the Social Security Commissioner.
